1. General Provisions
These Terms & Conditions govern reservations, accommodation services and the stay at Mariensztat 8 Boutique & City Hotel, Mariensztat 8, 00-302 Warsaw, Poland ("the Hotel").
By making a reservation or staying at the Hotel, the Guest agrees to these Terms & Conditions.
Reservations made through third-party booking platforms or travel agencies are also subject to the terms and conditions of the respective booking partner. In the event of any conflict regarding the reservation process, payment conditions, cancellation policies or other booking-related matters, the terms of the respective booking partner shall apply. These Terms & Conditions shall govern all accommodation services and other services provided directly by the Hotel, except where mandatory provisions of applicable law provide otherwise.
Any services, products or modifications arranged directly with the Hotel, including but not limited to additional guests, extra beds or bedding, room upgrades, parking, laundry services, breakfast, late check-out, early check-in, and any other additional charges or services, shall be governed exclusively by these Terms & Conditions and the policies of Mariensztat 8 Boutique & City Hotel.
Any services, products or modifications arranged directly with the Hotel, including but not limited to additional guests, extra beds or bedding, room upgrades, parking, laundry services, breakfast, late check-out, early check-in, additional charges, cleaning fees, compensation for damage to Hotel property, costs arising from violations of these Terms & Conditions, and any other services or charges provided directly by the Hotel, shall be governed exclusively by these Terms & Conditions and the policies of Mariensztat 8 Boutique & City Hotel.
2. Reservations
2.1 Reservation Methods
Reservations may be made directly with the Hotel through the official website and online booking engine, by email, telephone, in person, or through authorised booking platforms, travel agencies and other B2B travel partners.
2.2 Reservation Confirmation
A reservation is considered confirmed only after the Hotel has issued a booking confirmation and any required payment, deposit, pre-authorisation or other booking guarantee has been successfully received, authorised or otherwise accepted by the Hotel.
2.3 Reservation Guarantee
To secure a reservation, the Hotel requires:
a valid payment-card guarantee;
a payment-card pre-authorisation;
a reservation deposit or prepayment; or
full prepayment.
The applicable guarantee and payment conditions depend on the selected rate, booking method and reservation details and will be communicated when the reservation is made.
Reservations made directly with the Hotel by telephone, email or another method outside the Hotel's online booking engine must be confirmed by authorised Hotel personnel. The Hotel requires a reservation deposit, prepayment or another form of booking guarantee before confirming such a reservation.
A reservation is considered confirmed only after the required guarantee or payment has been successfully received, authorised or otherwise accepted by the Hotel.
2.4 Accuracy of Reservation Information
The Guest is responsible for providing complete and accurate reservation details, including their full name, contact information, arrival and departure dates, and the correct number of guests. The Hotel shall not be responsible for any inconvenience, additional costs or cancellation resulting from incorrect or incomplete information provided by the Guest.
2.5 Occupancy
A reservation is valid only for the room category and the number of guests confirmed in the booking. Additional guests, visitors staying overnight or changes to occupancy must be approved by the Hotel in advance and may be subject to additional charges.
2.6 Arrival Time
Guests are encouraged to provide the Hotel with their estimated arrival time whenever possible.
Mariensztat 8 Boutique & City Hotel operates a 24-hour reception and is able to accommodate late check-in, including arrivals after midnight, as well as early check-out during early morning or night hours. Guests expecting to arrive significantly later than their estimated arrival time are kindly requested to inform the Hotel whenever possible.
2.7 Special Requests
The Hotel will make every reasonable effort to accommodate special requests, including bed configuration, baby cots, accessibility requirements, room preferences, early check-in or late check-out. However, all special requests are subject to availability and are not guaranteed unless confirmed by the Hotel in writing.
2.8 Room Allocation
Reservations at Mariensztat 8 Boutique & City Hotel are generally made for a specific room selected by the Guest. While the Hotel will make every reasonable effort to provide the reserved room, the Hotel reserves the right to allocate an alternative room of the same or a higher standard where operationally necessary due to maintenance, technical issues, safety considerations or other unforeseen circumstances. Such a change shall not entitle the Guest to compensation, provided that the alternative accommodation is of an equivalent or higher standard.
2.9 Right to Refuse or Cancel a Reservation
The Hotel reserves the right to refuse, decline or cancel a reservation where:
false or misleading information has been provided;
the required payment or booking guarantee cannot be obtained;
fraudulent or unlawful activity is suspected;
abusive, threatening or inappropriate behaviour towards Hotel staff has occurred; or
cancellation is required to comply with applicable law or a decision of a competent authority.
2.10 Third-Party Booking Platforms
The Hotel is not responsible for inaccurate descriptions, prices, availability or other information displayed by third-party booking platforms or travel agencies where such information has been altered, delayed or incorrectly published by those third parties.
Guests are encouraged to review both the booking partner's terms and these Terms & Conditions before completing a reservation. Should any questions arise regarding the Hotel, its facilities, services, room features or other reservation details, Guests are welcome to contact the Hotel directly before or after making a reservation. The Hotel will make every reasonable effort to provide accurate and up-to-date information.
Reservations made through third-party booking platforms or travel agencies remain subject to the contractual relationship between the Guest and the respective booking partner. The Hotel is unable to cancel, replace or rebook such reservations directly, as doing so would breach its contractual obligations with its distribution partners. Any modifications, cancellations or refund requests relating to the reservation itself must therefore be processed in accordance with the terms and procedures of the respective booking partner, unless otherwise agreed by all parties or required by applicable law.
3. Purpose and Legal Basis
Your personal data is processed to:
manage and fulfil reservations;
provide accommodation and related services;
process payments and issue invoices;
communicate with you regarding your reservation and stay;
comply with legal and tax obligations;
ensure the safety and security of our guests and property;
handle complaints and improve our services.
Processing is based on Article 6(1)(a), (b), (c) and (f) of the General Data Protection Regulation (GDPR), as applicable.
For further information regarding the collection, processing, storage and protection of personal data, please refer to the Hotel's Privacy Policy, which forms an integral part of these Terms & Conditions.
4.1 Rates
All accommodation rates are quoted in Polish Złoty (PLN) and include applicable taxes unless stated otherwise. The rates applicable to a reservation are those confirmed at the time of booking.
Rates, minimum rates, minimum length of stay requirements, payment conditions and promotional offers are determined and authorised by the Hotel and may vary between the Hotel's official booking channels and third-party booking platforms or travel agencies.
The Hotel reserves the right to modify rates and reservation conditions for future bookings at its discretion. Confirmed reservations shall remain subject to the rates and conditions accepted at the time of booking.
4.2 Payment Methods
The Hotel accepts payment by cash, bank transfer and conventional payment cards.
4.3 Direct Reservations
For direct reservations made with the Hotel, a reservation deposit, prepayment or full prepayment is required to secure the booking. The amount, due date and method of payment shall be determined by the Hotel and confirmed at the time of booking.
Unless otherwise agreed in writing by the Hotel, the remaining balance shall be paid in accordance with the confirmed reservation terms. A reservation shall not be considered confirmed until the required payment or booking guarantee has been successfully received or otherwise accepted by the Hotel.
4.4 Third-Party Reservations
Reservations made through booking platforms or travel agencies are subject to the payment, cancellation and refund conditions of the respective booking partner.
Any payments, refunds, cancellations, modifications or other financial transactions relating to the accommodation reservation and processed by the booking platform or travel agency remain the sole responsibility of the Guest and the respective booking partner. Mariensztat 8 Boutique & City Hotel is not a party to such financial transactions and is unable to process, alter or refund payments collected by third-party booking platforms or travel agencies, except where required by applicable law or expressly authorised by the respective booking partner.
Any additional services, products or charges purchased directly from the Hotel before, during or after the stay shall be payable directly to the Hotel and shall be governed exclusively by these Terms & Conditions.
4.5 Additional Charges
Additional charges may apply for optional services, including but not limited to breakfast, parking, laundry services, additional guests, extra beds or bedding, room upgrades, early check-in, late check-out, cleaning fees, compensation for damage to Hotel property, costs arising from violations of these Terms & Conditions, or other services requested by the Guest.
4.6 Invoices
VAT invoices are issued in accordance with applicable Polish tax regulations.
Guests requiring a VAT invoice are kindly requested to provide the necessary billing details no later than the time of check-out. Unless otherwise required by applicable law, a final VAT invoice for accommodation services may only be issued after the stay has been completed and the payment obligation has arisen.
Where the Hotel has received a reservation deposit or advance payment, a corresponding VAT deposit invoice may be issued upon request following receipt of the payment, in accordance with applicable Polish tax regulations.
4.7 Failed Payments
If a required payment, payment guarantee or pre-authorisation cannot be successfully processed, the Hotel reserves the right to request an alternative payment method, suspend the reservation, refuse check-in or cancel the reservation, where permitted by applicable law.
5.1 Reservation Types
Mariensztat 8 Boutique & City Hotel offers a variety of reservation rates, each with its own payment, modification, cancellation and refund conditions. The availability, terms and conditions of each rate are determined and authorised exclusively by the Hotel.
All applicable reservation terms, payment conditions and cancellation policies are presented to the Guest before the reservation is completed. By completing a reservation, whether directly with the Hotel or through a booking platform, travel agency or other authorised booking partner, the Guest confirms that they have read, understood and accepted the conditions applicable to the selected rate.
Guests are responsible for reviewing the applicable reservation conditions before completing their reservation. If any information regarding a selected rate, payment conditions or cancellation policy is unclear, Guests are encouraged to contact the Hotel or the respective booking partner for clarification prior to confirming the reservation.
The Hotel cannot guarantee or verify the accuracy of rates, promotions or special offers published by third-party booking platforms or travel agencies. The Hotel is unable to provide information regarding the exact pricing, commissions or promotional conditions offered by such partners, nor can it offer a lower rate, price adjustment or price match after a reservation has been completed through a third-party booking platform or travel agency.
5.2 Cancellation by the Guest
Cancellation of a reservation by the Guest is governed primarily by the payment, modification and cancellation conditions applicable to the reservation rate selected and confirmed at the time of booking.
Guests are responsible for carefully reviewing and understanding the applicable reservation conditions before completing their reservation. By confirming a reservation, the Guest accepts the payment, modification, cancellation and refund conditions associated with the selected rate.
The Hotel cannot assume responsibility for personal circumstances or unforeseen events affecting the Guest's ability to travel or complete the reservation. Guests are therefore strongly encouraged to obtain appropriate travel insurance to protect against financial loss resulting from cancellation, interruption or modification of their travel plans.
Where required, the Hotel will provide reasonable documentation relating to the reservation, payments or stay to support insurance claims or other legitimate requests.
5.3 Third-Party Reservations
Reservations made through Booking.com, Expedia Group, travel agencies or other authorised booking partners are governed by the reservation rate, payment and cancellation conditions selected at the time of booking. Such reservations are offered in accordance with the commercial agreements established between Mariensztat 8 Boutique & City Hotel and its authorised distribution partners.
The Hotel honours the reservation conditions applicable to the selected rate but is unable to override, modify or disregard the payment, cancellation or refund procedures administered by the respective booking partner.
Where payment has been collected by a booking platform or travel agency, the Hotel cannot process refunds or alter financial transactions on behalf of that partner. Any requests concerning payments, cancellations or refunds must therefore be submitted through the respective booking partner, unless otherwise agreed by all parties or required by applicable law.
5.4 Reservation Modifications
Requests to modify a confirmed reservation, including changes to arrival or departure dates, length of stay, room type, occupancy, additional guests or other reservation details, are subject to availability and the terms and conditions applicable to the selected reservation rate.
The Hotel will make every reasonable effort to accommodate modification requests; however, modifications cannot be guaranteed and may result in a revised reservation rate, additional charges, or different payment, modification and cancellation conditions.
Reservations made through third-party booking platforms or travel agencies may require that modification requests be submitted and processed through the respective booking partner in accordance with their procedures, reservation terms and applicable conditions.
5.5 Early Departure and No-Show
Guests who choose to depart before the confirmed check-out date remain subject to the payment and cancellation conditions applicable to their reservation. Early departure does not automatically entitle the Guest to a full or partial refund unless otherwise provided by the applicable reservation terms or required by law.
A reservation shall be considered a no-show if the Guest fails to arrive on the scheduled arrival date without prior notification or agreement with the Hotel. In such cases, the Hotel reserves the right to cancel the reservation and apply the applicable payment and cancellation conditions associated with the selected reservation rate.
Where possible, Guests who expect to arrive significantly later than originally planned are kindly requested to notify the Hotel. Mariensztat 8 Boutique & City Hotel operates a 24-hour reception and will make every reasonable effort to accommodate late arrivals where the reservation remains valid.
5.6 Complaints and External Circumstances
Guests are kindly requested to notify the Hotel as soon as reasonably possible of any issue affecting their stay, including concerns relating to the room, facilities, cleanliness, maintenance, noise, or other accommodation services. The Hotel will make every reasonable effort to investigate the matter promptly and, where appropriate, provide a suitable remedy, which may include corrective action, an alternative room, or another reasonable solution, subject to availability and the circumstances.
Mariensztat 8 Boutique & City Hotel is located in the historic centre of Warsaw, where municipal works, conservation projects, public events and other activities may occasionally take place. The Hotel cannot control or assume responsibility for disturbances, inconvenience or temporary changes resulting from circumstances beyond its reasonable control, including but not limited to public road or street works, utility or infrastructure repairs, construction or maintenance works on neighbouring properties, municipal or government activities, emergency contractor works, waste collection, deliveries, traffic restrictions, public events, demonstrations, weather conditions or other external factors.
Where the Hotel is aware of planned works or circumstances that may reasonably affect a Guest's stay, it will make every reasonable effort to communicate such information through its official booking channels or authorised booking partners. However, the Hotel cannot guarantee that third-party booking platforms, travel agencies or other distribution partners will display or communicate such information accurately or in a timely manner.
The occurrence of external circumstances beyond the Hotel's reasonable control shall not, in itself, constitute a breach of these Terms & Conditions or automatically entitle the Guest to compensation, cancellation or refund. Failure to notify the Hotel of a concern during the stay may also limit the Hotel's ability to investigate the matter or provide an appropriate remedy before the Guest's departure.
6.1 Check-in
Standard check-in is available from the time confirmed by the Hotel or stated in the reservation confirmation. Early check-in may be available upon request, subject to availability, and may incur additional charges.
At check-in, each room must be assigned to a responsible adult Guest, who is required to present a valid government-issued photo identification, complete and sign the Hotel's registration card, and accept these Terms & Conditions on behalf of all occupants of the room.
The registration card must include the names of all Guests occupying the room. Where a reservation includes multiple rooms, or where one person has made reservations for additional Guests, each room must be checked in separately by a responsible adult Guest. Each responsible adult must present valid identification, complete and sign the Hotel's registration card, and accept these Terms & Conditions before access to the room is granted.
Minors are welcome when accompanied by a responsible adult and must be included on the registration card for the room in which they are staying.
6.2 Check-out
Guests are kindly requested to vacate their room by the standard check-out time confirmed by the Hotel or stated in the reservation confirmation. Late check-out may be available upon request, subject to availability, and may incur additional charges.
Upon departure, Guests are responsible for settling any outstanding balance relating to their stay, including additional services or charges incurred during their visit.
The Hotel reserves the right to contact or remind Guests who remain in their room beyond the applicable check-out time. The Hotel cannot assume responsibility for Guests who oversleep, fail to depart on time or otherwise remain in the room beyond the agreed check-out time without prior approval.
Guests wishing to extend their stay or request a later check-out must contact the Hotel in advance. Any extension remains subject to room availability, the confirmed reservations of subsequent Guests and the Hotel's operational requirements. Approval of a late check-out or extension is at the sole discretion of the Hotel and may result in additional charges.
Unauthorised occupancy beyond the agreed check-out time may result in additional charges in accordance with the Hotel's current rates and policies.
Where the Guest has failed to vacate the room by the applicable check-out time, has not requested an extension, and does not respond to reasonable attempts by Hotel personnel to establish contact, authorised Hotel staff reserve the right, in accordance with the Hotel's House Rules and operational procedures, to enter the room for the purpose of verifying the Guest's welfare, determining the occupancy status of the room, protecting Hotel property, or preparing the room for subsequent Guests. Wherever reasonably possible, such entry shall be carried out by at least two authorised members of Hotel personnel.
6.3 Unclaimed Property
Any property left behind by a Guest will be handled in accordance with the Hotel's Lost & Found procedures. The Hotel will make reasonable efforts to assist Guests in recovering lost property; however, any costs associated with packaging, insurance or shipping shall be borne by the Guest unless otherwise agreed by the Hotel.
7. House Rules
Guests are required to comply with the House Rules of Mariensztat 8 Boutique & City Hotel throughout their stay. The House Rules form an integral part of these Terms & Conditions and are established to ensure the safe, comfortable and respectful operation of the Hotel for all Guests, visitors and members of Hotel personnel.
The House Rules are available at the Hotel reception and on the Hotel's official website. By completing a reservation, checking in or remaining at the Hotel, the Guest acknowledges and agrees to comply with the applicable House Rules.
Failure to comply with the House Rules may result in additional charges, refusal of certain services, termination of the accommodation agreement or other actions permitted by these Terms & Conditions and applicable law.
8. Liability
Mariensztat 8 Boutique & City Hotel shall exercise reasonable care in providing accommodation and related services in accordance with applicable law.
The Hotel shall not be liable for delays, interruptions, disturbances or inconvenience resulting from circumstances beyond its reasonable control, including those described in these Terms & Conditions.
Guests are responsible for exercising reasonable care over their personal belongings during their stay. The Hotel's liability for loss of or damage to Guest property shall be governed by the applicable provisions of Polish law.
Guests shall be responsible for any damage, loss or additional costs caused to the Hotel, its property or third parties as a result of their actions or the actions of persons for whom they are responsible.
Nothing in these Terms & Conditions shall exclude or limit the Hotel's liability where such exclusion or limitation is prohibited by applicable law.
9. Applicable Law & Dispute Resolution
These Terms & Conditions and the accommodation agreement between the Guest and Mariensztat 8 Boutique & City Hotel shall be governed by and interpreted in accordance with the laws of the Republic of Poland.
The Hotel and the Guest shall make every reasonable effort to resolve any questions, concerns or disputes amicably and in good faith.
Where a dispute cannot be resolved by mutual agreement, it shall be subject to the jurisdiction of the competent courts of the Republic of Poland, unless mandatory provisions of applicable law provide otherwise.
Nothing contained in these Terms & Conditions shall limit or exclude any statutory consumer rights granted under applicable Polish or European Union law.
10. Final Provisions
These Terms & Conditions apply to all reservations and accommodation services provided by Mariensztat 8 Boutique & City Hotel unless otherwise agreed in writing or required by applicable law.
The Hotel reserves the right to amend these Terms & Conditions for future reservations in order to reflect changes in legislation, operational requirements or the services provided by the Hotel. Any amendments shall not affect reservations confirmed prior to the effective date of such changes unless required by applicable law.
The current version of these Terms & Conditions is available on the Hotel's official website and at the Hotel reception.
By completing a reservation, checking in or using the Hotel's accommodation services, the Guest acknowledges that they have read, understood and accepted these Terms & Conditions.
